This is a legal agreement between you, the end user, and the publisher of the Tarot-SG software, Kick The Fish Publishing LLC, a Florida Limited Liability Company (“licensor”), with regard to your use of the Tarot-SG software (“software”). By installing the Software, you agree to be bound entirely by the terms of this agreement.
- LICENSE. You are granted a license to install and activate the Software on a computer solely for your personal and non-commercial use. Sharing this Software with other individuals is in violation of this license.
- PURPOSE. You accept that the Tarot-SG2014 software is for entertainment purposes only and any decisions or actions you take from the use of it are your sole responsibility. Licensor and his agents are not liable for any damages, direct, indirect or consequential from the use of this program or its information, howsoever incurred.
- COPYRIGHT. The Software is owned by the licensor and sold through licensed affiliates. You may not resell, make any changes to, or otherwise adapt the software. Tarot images are licensed for this software and the copyright information displayed on the software.
- LIMITED WARRANTY. THE SOFTWARE AND ACCOMPANYING MATERIALS ARE PROVIDED ON AN “AS IS” BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, INCLUDING, BUT NOT LIMITED TO, ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR ANY PARTICULAR PURPOSE. NO ORAL OR WRITTEN INFORMATION OR ADVICE GIVEN BY THE LICENSOR, OR AGENTS LICENSED TO SELL THE SOFTWARE, SHALL CREATE A WARRANTY, OR IN ANY WAY INCREASE THE SCOPE OF THIS WARRANTY, AND YOU MAY NOT RELY ON ANY SUCH INFORMATION OR ADVICE. THE LICENSOR DOES NOT WARRANT, GUARANTEE, OR MAKE ANY REPRESENTATIONS REGARDING THE USE OR THE RESULTS OF USE, OF THE SOFTWARE OR WRITTEN MATERIALS IN TERMS OF CORRECTNESS, ACCURACY, RELIABILITY, CURRENTNESS, OR OTHERWISE, AND THE ENTIRE RISK AS TO THE RESULTS AND PERFORMANCE OF THE SOFTWARE IS ASSUMED BY YOU.NEITHER THE LICENSOR, OR ANY CONTRIBUTOR, DEALER, AGENT OR OTHER PERSON OR PERSONS WHO CONTRIBUTE TO THIS SOFTWARE , ITS ORIGINATION, SALE OR DELIVERY SHALL BE LIABLE FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL OR INCIDENTAL DAMAGES (INCLUDING DAMAGES FOR LOSS OF BUSINESS PROFITS, AND THE LIKE) ARISING OUT OF THE USE OR INABILITY TO USE SUCH PRODUCT OR RELATED TO THIS AGREEMENT, EVEN IF THE LICENSOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.IN NO EVENT SHALL THE LICENSORS LIABILITY EXCEED THAT OF THE PURCHASE PRICE OF THE SOFTWARE
- GENERAL. This Agreement and any dispute under it will be governed by the laws of the State of Florida and the United States of America, without regard to their conflict of laws principles. This Agreement constitutes the entire agreement between you and the licensor with respect to its subject matter, and supersedes other communication, advertisement, or understanding with respect to the Software. This Agreement may not be amended or modified except in a writing executed by both parties If any provision of this Agreement is held invalid or unenforceable, the remainder shall continue in full force and effect. All provisions of this Agreement relating to disclaimers of warranties, limitation of liability, remedies, or damages, and the licensors ownership of the Software survive termination,
- TECHNICAL COMPATIBILITY. THE SOFTWARE IS PROGRAMMED ON THE LATEST MICROSOFT PROGRAMMING PLATFORM AND HAS BEEN TESTED ON WINDOWS 7 ONWARDS – WE CAN NOT GUARANTEE THE SOFTWARE WILL RUN ON A PARTICULAR MACHINE OR PARTICULAR WINDOWS VERSION SO PLEASE VERIFY COMPATIBILITY BY DOWNLOADING AND TESTING THE SOFTWARE ON THE MACHINE ON WHICH YOU WILL RUN IT.IN SOME CASES YOU MAY NEED TO UPDATE YOUR WINDOWS INSTALLATION PRIOR TO INSTALLING THE SOFTWARE TO ENSURE YOUR PC IS RUNNING THE CURRENT WINDOWS SOFTWARE WITH ALL UPDATES. Visit http://update.microsoft.com to check your current configuration. WE WILL NOT ENTER INTO ANY DISCUSSIONS ABOUT COMPATIBILITY OR WINDOWS RELATED ISSUES, THAT IS NOT EXPLICITLY AND EXCLUSIVELY AN ISSUE WITH THE SOFTWARE ITSELF.
- LICENSE KEY. You warrant that before purchasing a license key, you have downloaded and tested the software on the machine on which it will run and that you accept this agreement.
- E-COMMERCE. We use Paypal.com as our approved e-commerce solution for payments. When paying you are redirected to Paypal.com’s site. Please address any payment issues, credit card or payment security issues by logging into Paypal.com.
- ACKNOWLEDGMENT. BY INSTALLING THE SOFTWARE, YOU ACKNOWLEDGE THAT YOU HAVE READ AND UNDERSTAND THE FOREGOING AND THAT YOU AGREE TO BE BOUND BY ITS TERMS AND CONDITIONS. YOU ALSO AGREE THAT THIS AGREEMENT IS THE COMPLETE AND EXCLUSIVE STATEMENT OF AGREEMENT BETWEEN THE PARTIES AND SUPERSEDES ALL PROPOSED OR PRIOR AGREEMENTS, ORAL OR WRITTEN, AND ANY OTHER COMMUNICATIONS BETWEEN THE PARTIES RELATING TO THE LICENSE DESCRIBED HEREIN.
NOTE: If you have a previous installation of Tarot-SG2014 (including the Beta tester) you must delete the folder C:/users/public/Tarot-SG2014 and uninstall the software from the control panel before installing the new version otherwise you may get error messages. If you saved spreads and notes you can back these up first using the ‘Options’ menu.
**Depending on your security settings, you may see messages about the software coming from an unknown publisher.
This is a standard warning with some high security setting and you should just choose to download anyway. Our software is all programmed on Microsoft’s own development software, is fully tested Windows compliant and is virus free!
